In August Governor Kathy Hochul announced that $1.3 billion dollars will fund the Health Care and Mental Hygiene Worker Bonus Program. The state would distribute the funds to health care employers, and the employers distribute the a specific bonus amount to eligible employees within 30 days.

The state launched the HWB program in August 2022 as a thank you to frontline health care workers for their tireless work during the pandemic and as an ” investment in health care,” Bonuses for employees are being determined by specific “vesting periods,” or hours worked during a consecutive six-month period between Oct.1, 2021, through March 31, 2024.

So far there have been two submission periods for employers to file claims for their eligible employees to receive up to $3,000 in bonuses. According to a spokesperson for the Health Department, all of the first vesting period bonuses, for which claims were submitted between Aug.3 and Sept.2 last year, have been released.

Employers have up to 30 days to distribute bonuses to their eligible employees. The submission period for the second vesting period was extended to include an additional month in November to allow employers more time to file claims. According to the Health Department’s website, payments for the second period were scheduled to be released beginning Jan.11.

  2. ABOUT THE HWB PROGRAM The $1.3 billion HWB program, enacted in the state’s fiscal year 2023 budget, will provide eligible workers who have annual base salaries less than $125,000, and will remain in their positions for at least six months.

Employers eligible for HWB program funding include providers participating in Medicaid with at least one employee, and other providers, facilities, pharmacies and school-based health centers licensed under the state Public Health Law, Mental Hygiene Law, and Education Law, as well as certain programs funded by the Office of Mental Health, Office for the Aging, Office of Addiction Services and Supports, the Office for People With Developmental Disabilities, and the Office of Children and Family Services.

At least 20 hours, but no more than 30 hours per week are eligible for a bonus of $500. At least 30 hours, but no more than 35 hours per week are eligible for a bonus of $1,000. At least 35 hours per week are eligible for a bonus of $1,500.

Eligible employees can receive up to $3,000 total over two vesting periods. Employees are ineligible if they have ever been suspended or excluded from the Medicaid program. Employers must enroll qualified employees in the HWB program, by creating an account in the online portal, and award the funds no later than 30 days after a worker’s eligibility for a bonus has vested.

Employers must be either currently enrolled and maintain an active MMIS ID with eMedNY or employers who do not have an MMIS ID, meaning they are not enrolled in the NYS Medicaid system, will need to verify they have a Statewide Financial System (SFS) ID. Employers who fail to do so for more than 10% of bonus-eligible workers could be fined up to $1,000 per violation of program rules. Workers will have to sign an attestation form confirming their eligibility for a bonus. Employers have to sign one, too.

Taxability of Bonus Payments These bonus payments are not considered taxable income for New York State personal income tax purposes, nor are they included in compensation for purposes of calculation of public benefits or assistance. Currently, there has been no guidance issued by the IRS related to its taxability for Federal Income tax purposes.

  1. However, based on previous comparable situations and absent of any specific guidance, these payments are taxable to the recipients for federal income tax purposes.

Is NY offering a back to work bonus?

New York $1,200 return to work bonus – Legislation was introduced on Tuesday by New York lawmakers that would authorize a $1,200 one-time bonus to those who are collecting unemployment benefits at the time the bill is passed. The bonus would be dependent on those workers maintaining the non-governmental position for at least four weeks.

The program is intended to provide relief to businesses paying “exorbitant increases in unemployment insurance rates” and reduce “the rate of unemployment claims in New York State is unsustainable for workers, businesses, and consumers.” Unlike other bills that have passed, t he New York bill doesn’t state whether there is a time limit from the date it is passed for a job to be taken.

A similar bill that passed the North Carolina Senate would give unemployed residents $1,500 signing bonus if they accept a job within 30 days of the bill’s approval. Otherwise those collecting unemployment compensation would get $800 if they accept a job within 60 days.

Is the NY governor giving money to healthcare workers?

Governor Kathy Hochul today announced the launch of the Health Care and Mental Hygiene Worker Bonus program, Enacted in the Fiscal Year 2023 New York State Budget, the program includes $1.3 billion allocated for the payment of recruitment and retention bonuses to certain health care and mental hygiene workers, a key initiative in the Governor’s aim to increase the state’s health care workforce by 20 percent over the next five years.

Bonuses will be awarded to eligible workers who make less than $125,000 annually and remain in their positions for at least six months. Disbursements will be commensurate with the number of hours worked and duration of service within designated vesting periods for up to a total of $3,000 per employee.
