In 2002, the government voiced its opposition to Walmart’s ambitions to acquire the Amigo Supermarket chain by filing a legal complaint in accordance with the Monopoly Law.

  1. However, at the time, the Secretary of Justice, Anabelle Rodriguez, made the decision that Walmart may purchase part of the Amigo stores as long as the company maintained the same number of employees and the same supply of Puerto Rican agricultural goods that the Amigo stores had previously.
  2. In 2005, the antitrust office initiated an inquiry to assess the extent to which the local market was impacted by the commercial activities of transnational chains.

After the overturn of the Certificates of Necessity and Convenience that were required to any drugstore interested in doing business in Puerto Rico, whether it was a local drugstore or a foreign drugstore, the skyrocketing trend of offshore drugstores settling on the Island sparked the inquiry that led to the opening of the investigation.

The certificate used the number of pharmacies that are packed into one square mile as well as the requirements of the region to decide where the new business should set up shop. These certifications were later rendered unnecessary. The results of this inquiry have not been made public as of this date, and the CPIPR has been unsuccessful in its attempts to view the files of this investigation on many occasions.

Jes Alvarado, Deputy Secretary for the Monopolistic Affairs Office, disclosed to the CPIPR that he had submitted a request for the investigative files from 2005. These data are now stored in an inactive archive that is housed outside of the Department of Justice.
