Article first published on January 29th, 2022 MILWAUKEE – According to a news release issued by the United States Department of Justice (DOJ), Hayat Pharmacy has come to an agreement whereby it would pay more than $2 million to settle accusations that it filed fake prescription claims to Medicare and Medicaid.

  1. Within the greater Milwaukee region, Hayat Pharmacy maintains a total of 23 different pharmacy sites.
  2. It was alleged by the prosecution that Hayat Pharmacy submitted false claims to Medicare and Medicaid in 2019 for two prescription medications.
  3. The medications in question were a topical cream containing iodoquinol, hydrocortisone, and aloe, as well as a multivitamin sold under the brand name Azesco.

During the time period that was relevant to this action, Medicaid paid thousands of dollars per prescription for the iodoquinol-hydrocortisone-aloe cream, but Medicare paid hundreds of dollars each prescription for Azesco. According to allegations made by the United States of America, Hayat Pharmacy allegedly transferred Medicaid and Medicare patients from lesser priced prescriptions to iodoquinolhydrocortisone-aloe cream and Azesco without any genuine medical necessity and/or without a valid prescription.

Attorney Richard Frohling stated in a news release that Medicare and Medicaid would only pay for prescription pharmaceuticals if the patient actually requires them. These programs will not pay for prescriptions that are distributed by pharmacies in an effort to raise their revenues.

“This settlement will make the federal government whole for the misconduct that was committed by the drugstore chain,” and it will impose a large penalty on Hayat Pharmacy.
